Terms of Service

By creating an account and using the StillHere mobile application ("the App"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the App.

StillHere is a daily check-in tool designed to notify your designated emergency contacts if you fail to check in for three (3) consecutive days.

• Email-Only Service: StillHere provides notification services via email only (from noreply@stillhere.co.nz). We do NOT provide SMS (text message) or phone call notification services.
• Emergency Contact Consent: By providing the email addresses of your emergency contacts, you represent that you have obtained their explicit consent to be contacted by StillHere.

• Calculation Method: The "three consecutive days" period is calculated based on natural calendar days (00:00 to 23:59).
• Timezone & Device Settings: The check-in deadline and the triggering of emergency alerts are determined by the time and timezone settings on your mobile device.

• Paid Service: StillHere is a subscription-based service. Continued access to the check-in and notification mechanism requires an active, paid subscription.
• Non-Renewal & Termination: If you do not renew your subscription or if your payment fails, the StillHere service will be automatically terminated. In such cases, your daily check-ins will no longer be monitored, and no emergency notifications will be sent to your contacts.

• No Guarantee of Notification: StillHere does not guarantee that notifications will be successfully delivered or received. Delivery depends on third-party services and internet connectivity.
• No Emergency Response: StillHere is NOT an emergency monitoring service (like 111/911). We do not dispatch emergency services or medical personnel.

Users are responsible for:

• Maintaining accurate personal information: Users must register and use their real, full legal name. Providing false, incomplete, or misleading information about your identity may result in account suspension or termination. StillHere relies on accurate user identification for emergency contact and safety purposes. Any consequences arising from providing inaccurate personal information, including but not limited to emergency contact failures, misidentification, or service disruption, are the sole responsibility of the User.
• Ensuring emergency contact information is correct
• Maintaining a functioning device and internet connection
• Ensuring emergency contacts receive confirmation emails: You are responsible for reminding your emergency contacts to check their email (including SPAM/JUNK folders) and confirm their status as an emergency contact. StillHere is not responsible if your emergency contacts fail to receive or confirm the notification email.

Users may update their information in the Settings page at any time.

When you add an emergency contact, StillHere will send a confirmation email to that contact. The contact must click the confirmation link to activate their status as an emergency contact. If the confirmation email is not received or confirmed, StillHere will not send emergency notifications to that contact.

StillHere may revise these Terms of Service at any time without notice. By continuing to use the App, you agree to be bound by the updated terms.

These Terms of Service are governed by and construed in accordance with the laws of New Zealand, and you irrevocably submit to the exclusive jurisdiction of the courts in that location.
